three montgomery county police officers. at one point, the civilian is struck by one of the officers. the amateur videographer who prefers to remain anonymous heard yelling from the officer who landed the blow. the argument started over a cigarette. >> and he was screaming, being aggressive. i heard him scream about the cigarette. he wanted the guy to put it out. obviously, there was a problem with it. he was smoke, you know, and the third officer had a problem with it, he doesn't like the way it smelled, it bothers him and the gentleman decided he was not going to put it out. to confirm, they sent him to pan a complex because of a call over a dispute between the man and woman over the ownership of a cell phone. the video shows one of the officers putting on gloves, pulling out what appears to be

a flashlight and kneeling down and poking the man in the back. it became -- the man to sit back down. the same officer begins a scuffle with the civilian. at one point, pulling on the man's dreadlocked hair until the civilian breaks away. a few seconds later, the policeman clouds the man across his chest and belly. we showed the video of the strike to montgomery county police spokesman captain paul starks. >> that is wrong, isn't it? >> if that is what occurred and that is not within our tripping -- training and doesn't look good on this tape and i want to hear from the officer. >> reporter: the video has no useful audio and recorded only parts of the encounter, both of those observations are true and he pointed out that no one filed a complaint about the police misconduct, the man

being detained or a videographer. upon seeing the video we supplied, internal affairs in the montgomery lice department opened an inquiry. at this point, all of the officers at the scene of that incident remain on full duty. will? >> that appeared to be troubling video. sean henrehan in the newsroom, thank you. a developing story in don's town. a bicyclist hospitalized with life-threatening injuries after being hit by the school bus. it happened on doppler's up to road near bellyville road. the bus driver suffered minor injuries. we're told that students were on board the bus when it happened and were not hurt. investigators are on the scene still trying to piece together what happened. a woman accused of leading police on achase through two states then trying to hit a security officer with her car outside of walter reed hospital has been ordered held without nd. angela cobalt is charged with first-degree assault and is arrested after crashing into the fence here. today, a judge ordered her held

until a psychiatric evaluation can be performed. her next bond review is a week from today. funeral arrangements are in place now. for a prince georges county police officer who died in a crash last week. the officer died on thursday. and viewings will be held friday and saturday and in saint clinton's baptist church in temple hills. his memorial service is at 11:00 a.m. on saturday at that church and he'll be buried at the mount oliveette cemetery. a again died this morning. the child was with the mother on the green line train. the baby was rushed to the hospital where it's pronounced dead. d.c. police are investigating. and the big story tonight,

you can't see the camera until you're on top of it. this camera generated $3.5 million the last fiscal year. where does that money go? well, the city said it goes into the general fund. in washington, beth parker, fox 5 news. staying on the roads, the traffic is back to normal on i- 95 north in stafford county. a fuel spill and crash shut down part of the interate for more than six hours -- hours. about 11:30 last night, the police say the suv ran off of the side of the road, overcorrected and hit a tractor-trailer. the jack knives spilled about 150 gallops of fuel. the driver of the suv was cited for wreckless driving. he and two others were hurt. the driver of the vehicle was not. a fairfax county family has no home to go to tonight after a fire ripped through their

founder and leader, the reverend was not hurt. michael skakle is be denied parole. he's serving 20 years in life for beating martha moxley with a golf club to death in 1995. during his first year, he claim he is innocent. the next parole hearing, 2017, and he's appealing his conviction. at that trial, it's set to begin next april. a case before the supreme court is putting consumers' rights at stake. it could mean you would lose the right to re-sell some of the products you own. it's a case not many people are talking about right now, but it could have far reaching affects. earlier, i spoke with andrew shore, the executive director of the owner's rights initiative and i asked him why this case has not gotten a lot of attention. >> it hasn't gotten a lot of

tag, one, because it's a presidential election cycle. a lot of stories get buried in there. two, the whole idea that when you buy something, you wouldn't be able to resell it or trade it or lend it or give it to charity, that is so absurd that it's -- it's hard for people to believe that this type of case would even be before the supreme court. >> and we should give some history here. the case stems from a college student who came from thailand to study at cornel in 1997, and he realized he could buy textbooks produced by john wiley and sons cheaper at home and thailand and should many shift to the u.s. and they made $1.2 million. wiley sued for copyright infringement and the counter was the first sale doctrine. explain to me, andrew, what does the first sale doctrine mean? >> right, the first sale doctrine is very simple. it says if you buy it, you own

it, and can you do with it as you will. the hiccup in the first sale doctrine is that the courts interpreted it to omagh, ply to goods made in the united states. the question that the supreme court's wrestling with is does the for sale doctrine extend to goods made overseas? that is the challenge in this case. >> so what product, what would this mean for consumers? what is at stake here for consumers with this case? >> there this could be disruptive for courages. it -- both on the buy side and the sell side. if you go out and you purchase a bicycle, you're now going have to figure out not only if it's made overseas, but if the manufacturer of the bicycle will allow you to rehill sell it or give it away to good will or donate it to someone, and you will have to go and make the decision with each product that you buy. >> and this could be the end of

vote. fox 5s paul wagner has more on that story. paul. >> reporter: the fight between the fof and the county began -- fop and the county began when u.s. officials learned a county government website being used to influence voters in favor of the county's position. then, the ads and that is when they came off. the ad on the bus paid for by a county government asks a simple question: who should run the police department? the chief or union leaders? with the bottom line urging residents to vote for question b. >> if you go to their website, if you go look at montgomery county buses, going to the libraries, you will see that montgomery county government placed materials in those forums advocating a political position on a question. who are not, to our knowledge, this never occurred before. >> reporter: when infuriating a union more came when the quest ask for equal time on the county-owned buses was denied and asked for help from the

it looks like, and this hasn't changed, that sunday will go down hill. we're going to have a good chance of rain around here, and it's going be chilly, too, with the temperatures only upper 50s to lower 60s for highs and definitely sunday looks wet and sunday looks chilly and i hope that changes but it depends on this here. >> and came earlier this afternoon. right now, it's basically sitting over the east sections of jamaica. the wins are up to 80 miles an hour. still a category 1 hurricane movement right now to the north and 14 miles per hour and give this a couple more hours. it will move off of jamaica and start to make landfall again in cuba. the pressure has been dropping. the winds have been going up. and the last few hours, she's begun to form an i and the last time the husent back word that i was about 50- miles wide. that is a substantial i, to

tell you the truth. this is the next the next few days, comes off of cuba from a weakened tropical storm off of the bahamas and reinvigorates itself so offshore of florida, we're talking about a potential category 1 hurricane again and moving slowly to the north and east and this is the official hurricane track from the hurricane center and something changeed a little knit, moved farther to the west, and you notice the last position here begins to jog to the left or towards the coast of the united states. talk about spaghetti miles basically. this is all of the models we looked at over the next 48 hours. the models are tightly packed through the bahamas and we get a great deal of divergence as we take this farther out into the future. again, what we're seeing now is more consistency in days four and five with the models and beginning to turn it back to the left or to the west or

forwards the mid-atlantic to jersey and new england. we believe by that period of time, it's transitioning from a tropical storm or a hurricane over to a extra tropical or a subtropical storm, and it's going to be packing wind meaning we'll -- we'll have to coop a close eye on the outure cast showing we're in good shape tomorrow, we'll take you into friday and have a few more clouds out there. limited sunshine. here's saturday morning, more clouds and this is why we think that sunday's going to be wet. this is the influence of hurricane sandy coming up the east coast, and it should be here by sunday. overnight tonight, watch out for foggy spots, 50s in the suburbs, 60 in town and nice tomorrow, and that is looks like sunshine and cooler and there is that look at your fox 5 accuweather seven-day forecast and i haven't made any changes, especially into the

. police made an arrest in the kidnapping and killing of a colorado girl. 17-year-old austin sig was arrested last night after police got a tip that led them to his home. he lives about a mile from the home of 10-year-old jessica ridgeway and she disappeared at the beginning of october. jessica's abduction was linked to the attempted abduction of a 22-year-old woman who was jogging in may and sig will be charged in both cases. two teenage brothers charged with killing a 12-year- old girl in new jersey left behind a trail of evidence in their home and online and they asked her to come to their

house on saturday and stole her bicycle, strangled her, and dumped her body in a recycling bin. the boy's mother tipped off police when show found a disturbing facebook on one of the son's accounts and authorities have not disclosed their names but prosecutors are trying to get them tried as adults. a louisiana claim the ku klux klan set had her on fire set herself on fire. she doused herself and started the fire. she claimed the kkk started the attack and on sunday night, she said that they wrote a racial slur and letters. the kkk on her car. the accusations spurred dozens of local, state, and federal investigators to spend hours looking into it. >> she had a lot of people believing it was racial issues. >> she is in the hospital in critical condition. investigators have figured out why she did it. the family said they're
